In order to enforce those standards, the state must be granted a waiver by the Environmental Protection Agency, something which Congress makes very clear should be given under virtually all conditions. We in Colorado have many days of problematic ozone. California is leading the way, but states are ready to follow.

One critical tool for forcing that reckoning comes from the Environmental Protection Agency (EPA). Through the Clean Air Act , and as affirmed—and reaffirmed—through multiple legal sagas, EPA is statutorily obligated to address carbon pollution from fossil fuel-fired power plants.

And New Jerseys pollution calamity isnt limited to rivers; ozone pollution is among the worst in the nation. According to the American Lung Association, all counties in New Jersey except for one fell into metropolitan areas that ranked among the twenty-five worst for ozone pollution.
