In an unpublished judgment, the court rejected the petitioners’ other NEPA arguments regarding project design and capacity and cumulative ozone impacts. In addition, the court found that BLM acted contrary to law by failing to consider a statutory directive to give “maximum protection” to surface values in the Teshekpuk Lake Special Area.
