My last post argued that EPA should immediately repeal the Obama Administration’s Clean Power Plan. It attempted to move away from fossilfuels and toward zero-carbon sources like solar power to supply electricity. The Clean Power Plan was based on section 111(d) of the CleanAirAct.
On March 24, the US Environmental Protection Agency posted information on how industries regulated under a variety of federal CleanAirAct programs could obtain Presidential Exemptions from those requirements.
Through the CleanAirAct , and as affirmed—and reaffirmed—through multiple legal sagas, EPA is statutorily obligated to address carbon pollution from fossilfuel-fired power plants. Section 111 of the CleanAirAct constrains how EPA sets standards—but gives states wide latitude in implementation.
California has a longstanding leadership role on transportation pollution, and the CleanAirAct grants the state the right to set strong vehicle emissions standards. While the waiver addresses California’s ability to enforce its rules, the CleanAirAct also allows other states the ability to adopt California’s policies.
That’s a far cry from just six years ago, when EVs were considered a niche technology (and the fossilfuel baron Charles Koch and his minions wanted to keep it that way). Today, the Union of Concerned Scientists (UCS) projects that 50 percent of US passenger car sales could very well be electric by 2030.
Although this is appropriate and in keeping with the structure of the CleanAirAct, each of the multi-state RTOs like PJM operate a single dispatch. Resource Links: -- EPA Finalizes Standards To Reduce Pollution From FossilFuel-Fired Power Plants -- Gov. Friel-Otten, Rep. Abney Introduce Gov.
CT , the Supreme Court said this: We hold that the CleanAirAct and the EPA actions it authorizes displace any federal common law right to seek abatement of carbon-dioxide emissions from fossil-fuel fired power plants. at 528–529. 7411(b)(1)(B); see also §7411(a)(2).
Since 2019, more than seventy local and state jurisdictions have followed Berkeley’s lead in requiring or strongly incentivizing all-electric or fossil-fuel-free new buildings, with more considering similar approaches. can be fueled by natural gas), and must base these options on a defensible “one-for-one” basis.
Despite the generous funding opportunities and holistic flexibilities baked into ACF, confusion around and misinformation about the rule may undermine this much-needed shift away from fossil-fueled trucks and buses. Flexibility in Advanced Clean Fleets Are there compliance extensions or exemptions within the ACF?
s lawsuit “artfully pled” that it was based on a local consumer protection law, it was actually premised on the federal common law governing interstate airpollution. The companies acknowledged that Congress’ enactment of the CleanAirAct supplanted the federal common law on airpollution.

In the first months of 2024, legislators in four states— Maryland , Massachusetts , New York , and Vermont —have pushed for legislation that would collectively require large fossilfuel producers and refiners to pay for hundreds of billions of dollars of state-level climate adaptation infrastructure.
Summary: Last week the Supreme Court handed down its second CleanAirAct case of the term, Utility Air Regulatory Group v. The case involved a challenge to EPA’s attempt to regulate greenhouse gases in the Prevention of Significant Deterioration (PSD) program of the CleanAirAct. Christopher D.
Shell on behalf of all the companies responded that the Solicitor General had effectively reversed the governments position that the CleanAirAct preempts claims in these climate cases. 7401 et seq. The outgoing Biden Administration had also opposed an effort by GOP-led states to block the suits.
EPA’s latest proposed rule targeting NOx emissions from fossil-fueled electric generating units (EGUs) is a classic study of diminishing returns. The downwind air quality benefits are minimal. Posted on June 29, 2022 by Eugene M. It marks the seventh round of NOx controls for the EGU sector since 1990.
Fossilfuel : Any mineralized formerly organic material extracted from the ground and used in energy production: coal, natural gas, oil. Indoor air (pollution) : coming under OSHA rather than EPA, there are laws in place to ensure that employees work in a clean and safe environment with good ventilation.
Circuit also rejected EPA’s argument that the court did not have authority to review stays issued under Section 307(d)(7)(D) of the CleanAirAct. Fourth Circuit Said West Virginia District Court Lacked Jurisdiction to Consider Coal Companies’ CleanAirAct Jobs Study Lawsuit. DECISIONS AND SETTLEMENTS.
On April 4, the PJM Interconnection sent a letter to the President supporting Presidential exemptions from the federal CleanAirAct requested by 13,900 MW of electric generation in the PJM region. Photos: Keystone and Conemaugh power plants.)
CleanAirAct appropriating $2.25 An additional appropriation of $750 million is made for the same set of activities in ports located in nonattainment areas, as designated under Section 107 of the CleanAirAct. States, Indian tribes, and airpollution control agencies are also eligible for funding.
Among the commenters was my colleague Sam Wilson , who passionately and effectively called on the EPA to follow the science and enact the strongest airpollution standards to protect people’s health. pollution, half of the deaths are attributable to the burning of fossilfuels. EPA’s PM 2.5 EPA’s PM 2.5
Beverly Wright, Vernice Miller-Travis , and Peggy Shepard, among others, shows that Black and brown communities are disproportionately exposed to and harmed by pollution. A myriad of studies since have validated these findings across a number of exposures, such as soot airpollution (PM2.5
We want to make sure that both workers and the community residents are protected under the guidelines of the CleanAirAct. The pollution amounts that will be associated with the increased operations and increased emissions of pollutants goes into the air we breathe.
Perhaps most importantly, this rule doesn’t even attempt to grapple with the question of how to eliminate emissions from trucks, focusing exclusively on fossil-fuel powered engines to the exclusion of electrification. Bad news: electric trucks aren’t included in the rule. Sadly, it didn’t.
Methane Emissions EPA announced it would reconsider regulations for the oil and gas industry under Section 111 of the CleanAirAct and Subpart W of the Greenhouse Gas Reporting Program. EPA also announced it would reconsider risk management rules that cover oil and natural gas refineries and chemical facilities.

2.5. ), mostly from fossilfuel consumption. The CleanAirAct (CAA) regulates smog, setting National Ambient Air Quality Standards (NAAQS) for ozone and PM. The interstate transport of airpollution is a longstanding problem. Many cities in the Northeast fail ozone and PM. In 2012, in.
Health First Pennsylvania is a dedicated bunch of health professionals, health advocates, parents, faith leaders, all dedicated to trying to make the use and extraction of fossilfuels, especially methane, in Pennsylvania, as safe as possible, and to limit the damage. Health exposures can also occur from spills or leaks.
The resemblance between the case is that both involve shifts from fossilfuels to cleaner energy sources — from coal to natural gas and renewables in West Virginia , and gas/diesel to electric vehicles in the new regulation. And even apart from climate change, EVs have the advantage of reducing smog and other airpollution.
The proposed rule would apply to new and existing gas plants and existing coal plants—new coal plants are separately regulated—and promises to significantly cut carbon and other harmful airpollutant emissions from fossil plants over the next two decades and beyond. Emphasis added.] The Court rejected this approach.
Shell faces lawsuit from climate change activists over fossilfuels Reuters | April 5, 2019 Environmentalist and human rights groups said on Friday they had started a lawsuit against Royal Dutch Shell in the Netherlands to force the energy firm to cut its reliance on fossilfuels.
Environmental Protection Agency announced it is strengthening its proposed standards to cut methane and other harmful airpollution. The updates would provide more comprehensive requirements to reduce climate and health-harming airpollution, including from hundreds of thousands of existing oil and gas sources nationwide.
“ We Refuse To Die ” is a multi-year, multi-city campaign that connects frontline communities in the Appalachia and the Ohio River Valley to communities in the Gulf South, and the Permian Basin, leveraging art, storytelling, ceremony, and action to stop the fossilfuel and petrochemical poisoning of communities, lands, and waters.
