As directed by a state law enacted in 2021, as HB 1286, the Colorado Health Department’s Air Pollution Control Division developed the newly finalized standards. As part of its target methodology , the state determined about 40% of the 8,000 buildings covered under the program already meet standards for the 2026 target.

Beginning in the 2026 ozone season, EPA is setting enforceable NOX emissions control requirements for certain sources at existing and new industrial facilities that have significant impacts on downwind air quality and the ability to install cost-effective pollution controls.

Now, SB 1137 protects communities by establishing a setback distance of 3,200 feet for homes, schools, parks, or businesses open to the public from new wells, and requires comprehensive pollution controls for existing oil wells within the setback zone. The SEC’s regime is an investor protection program, and nowhere in the SEC’s rule does a stated goal of pollution control or GHG emission reduction appear.

Many of the details remain to be determined by the EPA, but applications for funding will need to include “information regarding the degree to which greenhouse gas air pollution is projected to be reduced in total and with respect to low-income and disadvantaged communities.” The funding is set to remain available until September 30, 2026.
