In 1963, a typical car—which ran on leaded gasoline without pollution control devices— emitted 520 pounds of hydrocarbons, 1,700 pounds of carbon monoxide, and 90 pounds of nitrogen oxide every 10,000 miles traveled. Soon thereafter, it began extolling the virtues of battery electric vehicles , which it continues to do today.

Now, SB 1137 protects communities by establishing a setback distance of 3,200 feet for homes, schools, parks, or businesses open to the public from new wells, and requires comprehensive pollution controls for existing oil wells within the setback zone. Two new laws address this issue on different fronts.

As directed by a state law enacted in 2021, as HB 1286, the Colorado Health Department’s Air Pollution Control Division developed the newly finalized standards. As part of its target methodology , the state determined about 40% of the 8,000 buildings covered under the program already meet standards for the 2026 target.

Current estimates are that the law will impact over 10,000 companies, which will have to draft a report every two years, beginning January 1, 2026, and publish it on their own website. The SEC’s regime is an investor protection program, and nowhere in the SEC’s rule does a stated goal of pollution control or GHG emission reduction appear.
