The destruction we see today is a direct result of decades of dependence on fossilfuels, enabled by decades of deception and obstruction on the part of the fossilfuel industry, and prolonged by decades of inaction on the part of policymakers who have been in their thrall.
Through the CleanAirAct , and as affirmed—and reaffirmed—through multiple legal sagas, EPA is statutorily obligated to address carbon pollution from fossilfuel-fired power plants. The Supreme Court clipped the agency’s wings in its 2022 West Virginia v. EPA decision, but it did not ground EPA.
EPA on Thursday, June 30, 2022, curbing the power of the Environmental Protection Agency (EPA) to regulate greenhouse gas emissions from power plants across the country. The decision focuses on EPA’s authority under a specific section of the CleanAirAct. What does this mean for clean energy projects?
CARB’s Low Carbon Fuel Standard (LCFS) seeks to incentivize the production and sale of alternative, lower emissions transportation fuels in order to displace conventional fossilfuels. To identify which fuels should be promoted, CARB calculates the life cycle greenhouse gas emissions from transportation fuels.
In late December, the Treasury Department and the Internal Revenue Service (IRS) released proposed regulations for the Section 45V Clean Hydrogen Production Tax Credit. The tax credit, passed as part of 2022’s Inflation Reduction Act, provides a generous incentive for the production of clean hydrogen. Time matching.
Since the beginning of 2022, electric vehicle sales in the United States have been downright electrifying. That’s a far cry from just six years ago, when EVs were considered a niche technology (and the fossilfuel baron Charles Koch and his minions wanted to keep it that way). Those 807,956 EVs accounted for 5.8 percent in 2021.
At the same time, to avoid repeats of prior destructive stop-start policy lapses while simultaneously signaling a long-term incentive off-ramp, policymakers scheduled the tax credit to begin phasing out for resources coming online in 2033 or after power sector emissions are below 25% of 2022 levels, whichever is later.
They date from September 1978–when Congress passed an “act to establish a comprehensive and coordinated national climate policy and program”–to the Inflation Reduction Act of August 2022. Environmental Protection Agency highlighted the issue of Congressional authorization for administrative action on climate change.

Despite the generous funding opportunities and holistic flexibilities baked into ACF, confusion around and misinformation about the rule may undermine this much-needed shift away from fossil-fueled trucks and buses. The IRA also provides up to $100,000 in assistance per commercial vehicle charger under Section 30C.
In the first months of 2024, legislators in four states— Maryland , Massachusetts , New York , and Vermont —have pushed for legislation that would collectively require large fossilfuel producers and refiners to pay for hundreds of billions of dollars of state-level climate adaptation infrastructure.
Posted on June 29, 2022 by Eugene M. EPA’s latest proposed rule targeting NOx emissions from fossil-fueled electric generating units (EGUs) is a classic study of diminishing returns. The downwind air quality benefits are minimal. It marks the seventh round of NOx controls for the EGU sector since 1990.
It agreed with settled science that carbon dioxide from the combustion of fossilfuels is the major source of greenhouse gases, and that climate change is real. The Good The Supreme Court left the EPA’s overall ability to regulate greenhouse gases intact.

Image via PickPik On May 23, the Environmental Protection Agency (“EPA”) proposed emission limits and guidelines for carbon dioxide from fossilfuel-powered plants. To avoid the same fate as the Obama Administration’s Clean Power Plan, which was struck down by the conservative Supreme Court in West Virginia v.
The Infrastructure Investment and Jobs Act of 2021 (IIJA) and the Inflation Reduction Act of 2022 (IRA) represent a radical change in federal climate policy. Similarly, as our panelist Dustin Maghamfar has written , the IRA amends the CleanAirAct in ways that will have a qualitative impact. RSVP here !
Yet, despite several requests from states over the years, most recently California during a 2022 “heat dome” and wildfires, no White House has ever approved a disaster declaration for heat or smoke. Such communities are often already overburdened with pollution associated with fossilfuel burning and proximity to polluting industries.
I had a small glimpse into this work in early 2022 when his office reached out to me after reading a report I co-authored on the risk of chemical spills from storage tanks in Virginia. Among its provisions, the legislation will: Require consideration of cumulative impacts in permitting decisions under the CleanAirAct and Clean Water Act.
That includes 5 million deaths linked to breathing in the emissions of fossilfuels. In the United States, a 2022 study by researchers at the University of Wisconsin found that more than 50,000 lives per year would be saved by eliminating those emissions. He wrote in 2022 that deference “deserves a tombstone no one can miss.”

The Heritage Foundation’s argument against the 2022 rule reads the West Virginia case very broadly: “Under West Virginia v. EPA, the Supreme Court said for agencies to change policy so drastically, as Obama wanted to do to force power plants to change to renewable fuels, they must have clear direction from Congress.”
