The Department of Environmental Protection published notice in the April 27 PA Bulletin inviting public comments on a proposed declaration of an Exceptional Air Quality Event due to 2023 wildfires from Canada and New Jersey causing elevated levels of nitrogen oxides and volatile organic compounds impacting ozone pollution in Pennsylvania.

One of the most significant air quality challenges in the Basin is reducing emissions of the ozone precursor nitrogen oxides (NO x ) to meet the ozone standard attainment deadlines. The Environmental Quality Board is scheduled to meet August 9 final regulation setting a science-based manganese standard of 0.3mg/L as a Water Quality Criteria for Toxic Substances to protect public health and environment and make the point of compliance for the standard at the point of discharge into a river or stream.

Gene Yaw (R-Lycoming) on the Board expressed several concerns about the regulation, including whether the final regulation meets the requirements of Act 40 of 2017. The Board also approved a final regulation setting RACT (Reasonably Available Control Technology Standards) for major sources of nitrogen oxides. Read more here.

On November 18, the Department of Environmental Protection formally notified the Independent Regulatory Review Commission it was withdrawing the final regulation changing the water quality standard for manganese, ending the rulemaking process.
